EDITOR'S LETTER – NOVEMBER 2003

BRUCE HICKS, Senior Editor

PF&M, Volume 74 Issue 11, November, 2003

Dear Customer:

It has taken us quite awhile to get to this month’s topic, Inland Marine. This is a varied and flexible line of business. While it shares elements that are found in Property, Automobile, Ocean Marine and Liability coverage, it also has features that are quite distinct from any of its peer lines of business.

Inland Marine coverages exist in two different worlds and state regulators can’t agree on whether a given coverage should be subject to filing laws. For most of the time that insurance has existed, there has not been a standard definition of what constitutes an inland marine exposure. While saying that property capable of being easily transported is a solid way to identify some types of inland marine exposure, it isn’t the only way. Inland marine includes some types of property that is, for all intents, immovable, such as tunnels, bridges and other property that facilitates non-marine travel.

The latest and still existing, standard for identifying inland marine exposures was created by the National Association of Insurance Commissioners (NAIC). Originally written in 1933, the NAIC’s Nation-Wide Inland Marine Definition was last revised in 1976. It still acts as the major source used by states to guide their approach in recognizing what classes of property are members of the Inland Marine Family.

In this month’s update, we have taken a new look at our Inland Marine offerings. We are presenting you with a host of analyses of products from Insurance Services Office and the American Association of Insurance Services. You will find write-ups on both controlled (subject to state filing laws) and non-controlled types of IM coverage. We also have a section containing several articles of historical value which are useful for sake of reference.

Along with refreshing and reorganizing our Inland Marine Section, we also offer the following court cases:

We hope that you find this information useful in your efforts to serve the insuring public.

Sincerely,

Bruce Hicks, CLU, CPCU
